Read on for  Megaupload: the takedown . Last week, the US Government moved in on Megaupload, one of the most notorious and dominant forces in file sharing. The founders now stand accused of cheating rights holders out of $500m alongside racketeering and money laundering. The men arrested in several New Zealand raids included  Kim Dotcom (real surname: Schmitz), the founder of the online criminal enterprise that is estimated to have generated more than $175m in profit for its associates through advertising and premium memberships. Hugely popular site Megaupload.com was established in 2005, going on to attract 50 million visitors per day and is accused of hosting material under copyright including films, TV shows and of course music. Visitors could access content with a single click through to a digital locker and the founders are accused of deliberately facilitating mass online piracy. The site that occupied an estimated 4% of total Internet traffic is now indefinitely shut down, shelving plans that the company had to create  Megabox , a digital distribution service for unsigned artists. Unsurprisingly, Megaupload has also dropped its lawsuit against Universal Music Group for its takedown of the  Megaupload Mega Song , featuring endorsements of the file-sharing service from pop stars such as Kayne West and Mary J Blige. Conspiracy theorists will note that the raid hit the headlines in the same week that Wikipedia <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/b/> put the brakes on SOPA and PIPA, perhaps throwing the entertainment industries a sweetener despite the current setbacks in US legislation. However, the Department of Justice has confirmed that seven people associated with Megaupload were indicted by a federal grand jury earlier in the month over the charges. Kim Dotcom seems almost fictional, like a tech nerd version of a Scorsese character- The German born 38-year old former hacker owned a fleet of expensive cars featuring number-plates such as HACKER, MAFIA and GOD and was reportedly the world s number one rated online player at video game Modern Warfare 3. Holding previous convictions for insider trading, police had to cut him out of a locked panic room at his New Zealand mansion, at which they also discovered firearms. The move has sent shockwaves throughout those involved in sharing online content, with Filesonic disabling its  sharing facility and so-called hacktivist group Anonymous taking down the websites of the RIAA, Warner Music and Universal in retaliation at various times earlier in the week. Dotcom was remanded until today (25 January) and is awaiting a ruling on bail conditions. MegaUpload<http://i2.createsend3.com/ei/y/B8/246/7D6/csimport/megaupload .134654.png> IFPI: Digital up and streaming soars The International Federation of the Phonographic Industry (IFPI) has published a new report revealing an 8% growth in digital music revenues, with subscriptions to legal streaming sites increasing by 65% in 2011. The IFPI, who are essentially the global trade body for the music industry published their  Digital Music Report 2012 this week, stating that worldwide digital revenues from music hit an estimated $5.2bn, climbing year on year by an encouraging 3% from 5% growth in 2010. As a result, digital channels account for an estimated 32 per cent of record company revenues globally, up from 29 per cent in 2010, according to the report. Tracks and albums are available digitally in more countries than ever, a total of 58, with downloads in the US, South Korea and China accounting for more than half of the income generated by music companies. Paying subscribers of streaming services hit 13.4 million across the globe last year, with 2.5 million of these signing up to Spotify premium. Flipping over Tto the B-side, the percentage of Internet users accessing at least one site hosting illegal downloads per month is 27% in Europe and 28% worldwide, with around half using peer-to-peer networks- figures that revealingly don t show a decrease from the previous year. As recently reported <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/m/> , the Bill proposes a licensing exemption for venues under a capacity of 200, with certain stipulations for amplified and unamplified music. It was introduced into Parliament via the Lords by Tim Clement-Jones, and sponsored in the Commons by his Liberal Democrat colleague Don Foster. The Private Members Bill set out to address the shortcomings of the Licensing Act 2003 <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/c/> and the proponents were worried that it wouldn t have time to be heard in the Commons last Friday (20 January) but it managed to slip in as the daylight saving debate faded. The legislation now only needs to pass through the House of Lords for amendments to be considered but this largely considered a formality, as it is highly unusual for Bills to be rejected at the final hurdle before Royal Assent. Jo Dipple, acting CEO of UK Music, one of the organisations who have extensively lobbied in support of the Bill said: "This is a great day for music. The Live Music Bill will make a real and positive difference to lives of musicians. There is no doubt that the current Licensing Act has created needless layers of bureaucracy - making it complicated and expensive for pubs and other small venues to host live gigs . Unless you ve been on another planet for the last year (in which case, welcome back to economic meltdown, impending apocalypse and, even worse: Ed Sheeran), it should come as no surprise to hear that sales of pop albums have overtaken rock for the first time in seven years. According to the recent figures from the BPI, 7 out of the top ten selling albums in 2011 were classified as pop, with Adele s huge success <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/f/> leading the charge. Pop jumped up to claim 33.6% of the market, its biggest share of the year since 1999. Surprisingly, folk sales are showing their best sales of the century so far, up to 1.6%. I guess that we have Laura Marling to thank for that one. Coldplay's Mylo Xyloto and Noel Gallagher's solo debut High Flying Birds were the only rock entries in the year-end top 20 of 2011. This leads us back to the question that we asked earlier in the week about the BRITS nominations <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/z/> : Is pop music more interesting than rock right now and has commercially viable music been especially bland over the last year? BPI Chief Executive Geoff Taylor said:  2011 was a vintage year for Pop albums so it is hardly surprising that the genre has elbowed Rock aside as the nation s favourite Taylor continued:  Although Rock s share is the lowest for eight years, it still accounts for three in ten of every albums sold so recent reports of its demise are premature. So, is the hotly debated death of  guitar bands true or just a load of white noise? Despite the recent figures, there is evidence to the contrary- Enter Shikari went in at number 4 last weekend with third album  A Flash Flood Of Colour , an album released through their own  Ambush Reality label. Enter Shikari are an interesting example, having fared better over the years through self-releasing, with 2007 s  Take to the skies charting at four as opposed to 2009 s  Common Dreads , released on major label Atlantic peaking at 16. The DIY ethic is a key part of the band- they have even gone as far as cutting live promoters out of the picture and organising their own shows. In addition, you have artists such as The Maccabees now coming to commercial fruition for the Fiction label, which has steadily built the band up into a top five act. Fiction s Jim Chancellor recently said that guitar music needed a  shot in the arm <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/v/> and that labels were scared to invest in new guitar bands. Do you agree? Of course, pop music is by its very nature cyclical and connected to wider trends in popular culture and there were certainly a lot of  rock is dead proclamations in the early 00 s before The Strokes and The White Stripes kicked the doors down, taking rock records back to the top of the charts. Are people waiting for the next big cult band like The Smiths or Nirvana to break through to the mainstream? If so, they may be waiting some time- intelligent, literary rock isn t exactly top of the agenda right now and there aren t too many labels who can afford to stick their necks on the line and hold out for long enough to create slow-burning success stories. Who could afford to support and build up the next REM in this climate? The last few years have been more focused than ever on rock reunions of varying quality but music fans ultimately want more than nostalgia. It all comes back to artist development and it could be argued that Development Agencies such as Generator have a greater part to play than labels in supporting emerging talent. The days of rock success are far from over - Look at The National, who enjoyed their biggest commercial and critical year yet in 2010 after 11 years on the American indie scene. They have just been announced as the curators of the All Tomorrow s Parties festival in December and these events often sell-out despite tough economic times for live music, proving that there is a thriving and successful, though not entirely guitar dominated alternative scene in the UK and further afield. In addition, artists from St Vincent to the Trailer Trash Tracys are finding new ways to make the electric guitar sound exciting. Therefore, we re inclined to agree with at least the part of Taylor s statement that reports of rock s death have been greatly exaggerated lately. Wikipedia took its English-language content offline for 24 hours as part of a  day of darkness in protest to SOPA, which it says could  fatally damage the free and open nature of the Internet and  limit people s access to online information . It was also joined by blackouts from other US based sites including Reddit and Boing Boing. In a furore that, to an extent echoes debate in the UK around the implementation of the Digital Economy Act <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/yu/> , House of Representatives bill SOPA has seemingly kicked up so much fuss due to its proposal of using Domain Name System (DNS) blocking of suspect sites. The bill also states that search engines should remove infringing sites from their results and that US government and rights holders would have the right to seek court orders and shut down against any site accused of "enabling or facilitating" piracy. The broad definition of this seems to be a particular sticking point, meaning that a site containing links to music, films or other content under copyright, could be in danger of being taken off-line. However, SOPA and the Protect Intellectual Property Act (PIPA) both seem unlikely to go any further, at least in their current form, with Speaker of the House Of Representatives John Boehner saying that he didn't feel either could now go to his congressional chamber for a vote. Wikipedia is now back online (phew!) but has declared:  We re not done yet , saying that their blackout had encouraged eight million people to contact politicians to protest about SOPA. In a faintly comical twist, Rupert Murdoch popped up in the middle of the debate like a pantomime villain, taking to Twitter and basically saying that Google facilitated piracy. Presumably Murdoch is now busy paying damages to those 37 victims of phone hacking that he knew absolutely nothing about. As previously reported <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/jr/> , EMI s labels were sold to Universal Music in November last year for 1.2bn, with a consortium led by Sony set to acquire the publishing catalogues for 1.35bn. However, AIM are stepping up their collective resistance to the sale and has issued a letter to its members, urging the to use it to lobby their local MPs. The letter, which is also posted on their website <http://generator.createsend3.com/t/y/l/yhthikt/nmyklks/jy/> highlights the achievements of the independent sector over the last year, stating that Universal and Sony would have a shared market value of 50% if the sale goes ahead. It states: "The increasing concentration of the music market in the hands of a decreasing number of gigantic multinationals has undoubtedly damaged competition. The proposed sale of EMI threatens further damage so great that it must be reviewed and resisted by the UK Coalition Government with the full support of the Opposition . The letter goes on to quote Beggars Chairman Martin Mills, who called the sale "bad news for almost everyone involved in the art and business of music". AIM is hoping to put pressure on the Secretary of State for Business, Innovation and Skills to intervene. There was also speculation in the thrillingly titled Legal Times last week that Warner Music were also gearing up to oppose the sale, which if it goes ahead will certainly relegate them to being the smallest of the major music companies.
